The short version
Tameside Tails on Trails is made by Howarth Games — Martin Howarth, a sole trader in England. Using the app means accepting these terms. Tracking a walk, your dogs and the first aid library are free. Some parts of the app need a subscription, the app says which before you buy, and a subscription renews until you cancel it in the App Store.
What you are given
A personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own purposes. Not to sell, rent, sub-licence or redistribute, and not to decompile or reverse-engineer except where the law says you may whatever a licence claims.
The app and everything in it — the code, the artwork, the words, the first aid library — stays ours. Everything you put into it stays yours.
Subscriptions
Part of the app is free and part needs a subscription. Which is which is stated in the app itself, and the price shown is the one Apple gives it for your country and currency.
- Two lengths: monthly, which renews every month, and quarterly, which renews every three months.
- A subscription renews automatically until it is cancelled. Apple takes the payment from your Apple Account, within 24 hours of the end of each period.
- Cancel it in the App Store, under your Apple Account subscriptions, at least 24 hours before the period ends. Cancelling stops the next renewal and leaves the period you have paid for running to its end.
- It cannot be cancelled from inside the app, because Apple does not allow that.
- Refunds are Apple’s to give: we take no payment and hold no card details. Write to us anyway if something has gone wrong.
What a subscription unlocks may change as the app grows. If something free today ever moves behind a subscription, anyone already subscribed keeps it, and it is announced beforehand rather than after.
Your email address is what a subscription is allocated to. You can decline to give it, and the app keeps working — the subscription-based parts simply stay locked. The privacy notice explains exactly what happens to that address, and forms part of these terms.
What stays free
Tracking a walk, the dogs on your account and the first aid library are free, and the first aid library will stay free permanently. A page telling somebody what to do about a choking dog is not going behind a payment screen.
First aid is reference, not veterinary advice
This one matters enough to be plain about.
- The first aid library is general reference. It is not veterinary advice and it is not a substitute for a vet.
- In an emergency, ring a vet. Do that first and read afterwards.
- Reminders — a jab due, worming overdue — are a convenience, not a clinical system. Do not rely on them alone for anything that matters to your dog’s health.
- What you record is your record. We do not check it, correct it, or keep a copy.
Tracking a walk
Tracking uses your phone’s own positioning and runs while the app is open. Accuracy depends on the phone, the sky and the ground, so a recorded distance or route is an estimate. Watch where you are actually walking rather than the screen.
Acceptable use
Do not use the app unlawfully, do not attempt to break or overload anything of ours, and do not use it to store material you have no right to hold.
Availability
The app is provided as it is. We do not promise it will be uninterrupted or free of faults, and features may be added, changed or withdrawn as it develops. We will not knowingly break something you have paid for without telling you.
Liability
To the extent the law allows, Howarth Games is not liable for indirect or consequential loss arising from using the app, and any liability we do have is limited to what you have paid us in the twelve months before the claim. Nothing here limits liability for death or personal injury caused by negligence, or for fraud, and nothing here affects your statutory rights as a consumer.
Ending it
You can stop using the app and delete it at any time, which deletes what it holds on your phone. We may end this licence if these terms are broken. Cancelling a subscription does not delete anything already on your device.
Changes to these terms
These terms may be updated, with the new date at the top of this page. A change that materially affects a subscription will be said in the app as well.
Law
Governed by the law of England and Wales, whose courts have jurisdiction. If you live elsewhere in the UK or the EU, you keep the protection of your own country’s consumer law.
