Who this is between

These terms are the agreement between you and Howarth Games — Martin Howarth, a sole trader in England — covering the Howarth Games apps and this website. Using an app means accepting them. If you do not accept them, do not use the app.

What you are given

You are granted a personal, non-exclusive, non-transferable licence to use the apps on devices you own or control, for your own purposes. You may not sell, rent, sub-licence or redistribute them, and you may not decompile or reverse-engineer them except where the law says you may whatever a licence claims.

The apps and everything in them — the code, the artwork, the words, the first aid library — remain ours. Everything you put in them remains yours.

Subscriptions

Not every Howarth Games app has a subscription. Where one does, the app says so plainly before you buy anything, states which parts need it, and shows the price Apple gives it for your country and currency. Where an app has none, everything in it is simply free and this section does not apply to it.

• Two lengths are offered: monthly, which renews every month, and quarterly, which renews every three months.
• A subscription renews automatically at the end of each period until it is cancelled. Payment is taken by Apple from your Apple Account.
• Apple charges the renewal within 24 hours of the end of the current period.
• Cancel it in the App Store, under your Apple Account subscriptions, at least 24 hours before the period ends. Cancelling stops the next renewal; the period you have already paid for keeps running to its end.
• It cannot be cancelled from inside the app, because Apple does not allow that. The app can only send you to the right place.

Refunds are handled by Apple under their terms, not by us: we take no payment and hold no card details, so there is nothing here to refund from. If something has gone wrong, write to us anyway — see below.

What a subscription unlocks may change as an app grows. If a part of an app that is free today ever moves behind a subscription, anyone already subscribed keeps it, and the change is announced before it happens rather than after.

What the free part gives you

An app is usable without a subscription, and what is free is stated in the app itself. First aid guidance is free in every app that has it, permanently, and will not be moved behind a payment screen.

Your data

What an app records stays on your device. The only personal information ever sent to us is a subscriber’s email address, and only so the subscription can be recognised as yours. The privacy policy sets this out in full and forms part of these terms.

First aid, veterinary and medical content is reference, not advice

Some apps include first aid guidance and let you record medical details for an animal. This matters enough to be plain about:

• The guidance is general reference. It is not veterinary advice and it is not a substitute for a vet.
• In an emergency, ring a vet. Do that first and read afterwards.
• Reminders in an app — a jab due, a farrier due, a fit check overdue — are a convenience, not a clinical system. Do not rely on them alone for anything that matters to an animal’s health.
• Anything you record is your record. We do not check it, correct it or keep a copy.

Tracking a walk or a ride

Location tracking uses your device’s own positioning and runs while the app is open. Accuracy depends on the phone, the sky and the ground, and a recorded distance or route is an estimate. Pay attention to where you are actually going rather than to the screen.

Acceptable use

Do not use the apps unlawfully, do not attempt to break, probe or overload anything of ours, and do not use them to store material you have no right to hold.

Availability

The apps are provided as they are. We do not promise they will be uninterrupted or free of faults, and features may be added, changed or withdrawn as they develop. We will not knowingly break something you have paid for without telling you.

Liability

To the extent the law allows, Howarth Games is not liable for indirect or consequential loss arising from using the apps, and any liability we do have is limited to what you have paid us in the twelve months before the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — and nothing here affects your statutory rights as a consumer.

Ending it

You may stop using an app at any time and delete it, which deletes what it holds. We may end this licence if these terms are broken. A cancelled or ended subscription does not delete what is on your device.

Where Apple stands

You bought the app through Apple’s App Store, and Apple requires these terms to say plainly what Apple is and is not responsible for. This section is here because Apple asks for it, and because it is the honest answer anyway: the app is mine, so the obligations are mine.

These terms are between you and me. Apple is not a party to them. Apple did not write the app and does not stand behind it.

What you are licensed to do. The licence above is personal, non-exclusive and non-transferable, to run the app on Apple-branded devices you own or control, and it is subject to the Usage Rules in Apple’s own Media Services Terms and Conditions.

Help with the app comes from me. Apple has no obligation to provide any maintenance or support for it. If something is wrong, write to me — the address is at the bottom of this page.

Warranty. Any warranty on the app is mine, not Apple’s. If the app fails to conform to a warranty that applies to it, you may tell Apple, and Apple may refund what you paid for it; beyond that refund, Apple has no warranty obligation of any kind, and anything else — losses, costs, claims — is my responsibility rather than theirs.

Claims about the app. Apple is not responsible for addressing any claim you or anyone else makes about the app or your use of it: product liability, a failure to meet a legal or regulatory requirement, consumer protection, privacy, or anything similar. Those are mine to answer.

Intellectual property. If anyone claims the app infringes their intellectual property, dealing with that claim is my responsibility, not Apple’s.

Where you are. By using the app you confirm that you are not in a country subject to a US Government embargo or designated by the US Government as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties. That wording is Apple’s requirement rather than mine, and it applies to every app on the App Store.

Other people’s terms. Where the app uses a third party’s service, you must keep to that third party’s terms as well as these.

Apple can enforce this section. Apple and its subsidiaries are third party beneficiaries of these terms, and may enforce them against you directly.

Changes to these terms

These terms may be updated. Any change is posted on this page with a new “Last updated” date, and a change that materially affects a subscription will be announced in the app as well.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live elsewhere in the UK or the EU, you keep the protection of your own country’s consumer law.
